Under the Canada Pension Plan, contributions you and your married or common law spouse made throughout the marriage or relationship may be divided equally after divorce or separation. The parties may also agree to retain their own CPP benefits accrued during the marriage. A division of CPP is not automatic and requires an application to the Human Resource and Skills Development Canada for a distribution of the credits. Their website contains an application form and information with respect to this issue.
Employment pension benefits accrued during marriage are matrimonial property and subject to a presumption of an equal division under the Matrimonial Property Act.
Employment pension division is usually very complicated and requires professional assistance.
